Appeals

 

A number of clients have to exercise their right of appeal to address issues they may have with the decisions made on their case.    If you believe CSA have made a decision that is not within the remit of the legislation, you may have to appeal the decision to allow an Independant Tribunal to consider the matter and make the appropriate ruling.

 

Do be aware, not all decisions carry the right of appeal.  You can only appeal certain decisions and any such appeal application must be made within a specific time frame.

 

Our Appeals support package can be tailored to assist with each stage of the appeal process:

 

  • Assistance with the application for appeal to First Tier Tribunal, through to the study of the Appeal Submission Bundle and report on how to respond and prepare for the Appeal hearing.
Or
  • Study of the Statement of Reasons, and other associated paperwork relevant to a First Tier Tribunal decision that is to be appealled to Upper Tribunal.  You can only appeal to the Upper Tribunal on a point of law.  You must request a Statement of Reasons before appealling a First Tier Tribunal.

If the Upper Tribunal have considered your application, and rejected the appeal request, you have to apply to Court of Appeal/Judicial Review.  You will require appropriate legal assistance for this process.  NACSA has a list of solicitors that can provide any application for Court of Appeal/Judicial Review - please email This e-mail address is being protected from spambots.
